Terms of Use

TELURICO is developed and administered by Pragmatic Business Solutions, LLC (PBS), Rio Grande City, Texas, USA. Contact info@pragmaticsolutions.app. These terms cover public information, accounts and released applications. Organization workspaces also use the Organization Terms. Accounts are for adults with authority to agree; use individual credentials and protect invitation tokens.

TELURICO does not predict earthquakes or operate a public early-warning service. Source information may be preliminary, delayed, incomplete, revised or incorrect. A missed message does not establish safety. Follow local authorities and take protective action without waiting for TELURICO. A local test demonstrates only the stated interface or delivery test.

Public information does not require an account, sensing, a location permission or payment. Optional push, reporting and participation choices are separate. Country selection is a browsing choice, not residence or sensor position. Magnitude is not local shaking intensity. Reports are subjective and are not rescue requests.

You retain rights in your original submissions and permit only processing needed for the features you choose. Do not fabricate reports, harass others, expose private information, access another workspace or bypass safeguards. Source data and software retain their applicable rights. External sharing follows the recipient service’s practices.

PBS may proportionately restrict abuse or security threats. You can remove contacts, withdraw optional notification consent, export your data and request deletion. Charges require a separate clear offer and affirmative purchase. No paid plan or guaranteed protective outcome is offered in this release.

To the extent permitted by mandatory law, the service is provided subject to its disclosed limitations, without promises of uninterrupted delivery or detection. These terms do not exclude nonwaivable consumer, privacy or statutory rights, or liability that cannot lawfully be limited. No compulsory arbitration, class-action waiver or fixed consumer damages cap is imposed. A valid choice of Texas law does not displace mandatory local rights or available consumer courts. Contact PBS for informal resolution without losing regulatory or judicial remedies.

Material changes carry a version and effective date, with notice and renewed acceptance when required. EN/ES/PT versions preserve mandatory language and interpretation rights; no English supremacy clause applies.

Scope and contracting party

These Terms apply to TELURICO websites, dashboards, APIs, web applications, native applications when distributed, demonstration environments and associated features. Your agreement is with Pragmatic Business Solutions, LLC, located in Rio Grande City, Texas, USA. PBS’s members, owners, managers, employees, contractors and licensors are intended beneficiaries of the applicable protections below. They do not personally become parties or guarantors merely by developing or operating the service. This provision does not remove liability imposed by mandatory law.

Limited license and intellectual property

Subject to these Terms, PBS grants a revocable, nonexclusive, nontransferable license to access the service and use legitimately distributed applications for their documented purpose. PBS reserves rights in original software, designs, names and materials. You may not impersonate PBS, remove required notices, resell restricted account access, circumvent controls or infringe others’ rights. Open-source components and public source datasets retain their own licenses; those licenses are not narrowed by this agreement. No ownership in your original messages or submissions transfers to PBS.

Communications, resources and reasonable reliance

Chat and voice/video calls require accepted contacts. Calls require microphone or camera permission and an open web application to receive them. PBS does not record calls. Communications can fail during outages, device restrictions or loss of connectivity. Resource listings are directory information, not emergency dispatch, rescue requests, verified shelter admission or safe-route guidance. Do not rely exclusively on TELURICO for life-critical decisions, essential communications or evacuation instructions. Consult competent local authorities.

Service availability and third parties

Beta and research features may change, be withdrawn or be limited for maintenance, capacity, quality or security. Internet services, browser providers, carriers, maps, source catalogs and app stores operate independently. Their policies and failures may affect service. PBS is not responsible for content or commitments made solely by third parties, subject to duties that applicable law places on PBS. No source attribution, country selection or platform logo establishes partnership, certification or government endorsement.

Warranty limitations

TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED AS IS AND AS AVAILABLE. PBS AND THE PROTECTED PARTIES DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGING USE, AND DO NOT WARRANT UNINTERRUPTED OPERATION, PERFECT SECURITY, DETECTION ACCURACY OR TIMELY DELIVERY. Express obligations in a signed agreement and mandatory consumer warranties remain effective. Public safety or geographic coverage claims require demonstrated evidence; a beta download does not supply that evidence.

Business liability limits

For business users, to the extent enforceable under applicable law, PBS and the protected parties are not liable for indirect, incidental, consequential, punitive or special losses, lost profits, lost business or lost opportunity arising from use or inability to use the service. Their combined aggregate liability for claims connected with the service is limited to the greater of USD 100 or fees paid to PBS for the affected service in the twelve months before the event. A negotiated agreement may provide different limits. This business limit does not impose a fixed consumer damages cap or reduce mandatory remedies.

Exceptions to limitations

No disclaimer, limit, release or indemnity excludes fraud, intentional misconduct, gross negligence, death or personal injury where such exclusion is unlawful, statutory data-protection duties, nonwaivable consumer remedies or any liability that cannot lawfully be excluded. Limitations apply only as far as the law permits. The service’s limitations describe its capabilities; they do not immunize unlawful conduct or waive Texas consumer protections.

Business indemnity

To the extent permitted by law, a business user will defend and indemnify PBS and the protected parties against third-party claims and reasonable costs caused by that user’s unlawful submissions, infringement of third-party rights or material misuse of the service. This obligation excludes losses caused by PBS’s own wrongful conduct and does not create a general consumer indemnity. PBS will give reasonable notice and cooperation. No settlement may admit fault or impose nonmonetary duties on a protected party without its consent.

Texas law and dispute venue

Except where mandatory law or a valid signed agreement requires otherwise, Texas law governs these Terms. Parties submit disputes to competent state courts in Starr County, Texas, or, when federal jurisdiction exists, the United States District Court for the Southern District of Texas, McAllen Division. Mandatory local consumer courts, privacy regulators and other nonwaivable remedies remain available. Contact info@pragmaticsolutions.app for informal resolution; doing so is optional and does not suspend legal deadlines. These Terms impose no compulsory arbitration or class-action waiver.

Suspension, termination and events outside control

PBS may proportionately suspend access for material misuse, security threats, legal requirements or technical necessity, with notice when practicable. You may stop using the service and use account export and deletion controls. Lawful restrictions and required records may survive termination. PBS is not liable, to the extent the law permits, for delay caused by events beyond reasonable control such as disasters, power loss, carrier outages or source-provider failure; this does not remove legally required mitigation or notification duties.

Changes, interpretation and remaining provisions

Material changes receive a new version and effective date. Account users are asked to accept updated terms before continuing actions covered by the changed agreement; export, deletion, consent withdrawal and legal remedies remain accessible. Optional sensing, notifications and location searches require their own consent. If a provision is unenforceable, it is limited or severed as the law allows and the remaining provisions continue. A failure to enforce once is not a waiver. A signed feature-specific agreement controls an actual conflict within its scope. EN/ES/PT versions preserve mandatory translation and interpretation rights.
